2 Large Verdicts in New Asbestos Cases


Even as Congress debates limiting asbestos lawsuits, juries in New York and Illinois have reached two of the largest verdicts yet in cases where workers are dying of asbestos-related cancer.

The verdicts, reached last week, are part of a new wave of cases against companies that did not make asbestos or use it in their products but used products containing asbestos in their buildings or factories.

Insurance companies are especially vulnerable to the new suits because they must pay for the claims under their premises-liability coverage, which usually has no dollar limits, said Perry Weitz, whose law firm won the New York case.

As traditional asbestos defendants, like asbestos manufacturers or companies that make insulation, have gone bankrupt, plaintiffs’ lawyers have looked elsewhere, seeking to persuade juries that the new defendants should be held liable.

‘’The only reason that there’s more of a focus now on these cases is because the manufacturers are in bankruptcy,'’ Mr. Weitz said.
